Midtown Residents Comments/Complaints

May 24, 2007 Liquor License Report
The Midtown Neighbors' Association voted as follows on Liquor License Applicants:

Whole Foods Market Restaurant, 650 Ponce de Leon Avenue - voted not to oppose

Kat's Cafe, 970 Piedmont Avenue, Suite 100 - voted not to oppose, with the following concerns:

1. They plan to have live entertainment so the Noise Ordinance was discussed. "During nighttime hours, sound emanating from any noise source shall be limited in volume, tone and intensity so that the sound shall not be plainly audible to any person at a distance of 50 or more feet from the property....."

2. Liquor Licenses are not allowed within 300 feet of a residence. They are across the drive way from a residence. The attorney Mr. Martin, says they submitted a plan to the police department showing that they comply with this. We did not see the plan and wonder how they are in compliance.
